Abstract

South Asia has witnessed one of the most protracted social movements for liberation in Indian Illegally Occupied Jammu and Kashmir. Since 1947, despite UN resolutions in favor of granting the right of self-determination to the people of Kashmir, India has not shown compliance. With the shrinking of hopes for a political solution, however, once again, the resurgence of freedom struggle in the Indian Illegal Occupied Jammu and Kashmir provoked by the killing of a young Kashmiri freedom fighter named Burhan Uddin Wani in 2016 was further triggered by abrogation of article 370. Hence, this research study aims to highlight the resurgence of freedom struggle and the Indian hard power response towards a political solution and also to examine the uncompromising political approach towards Kashmiris, as well as lackluster response of the international community particularly the Western bloc. This paper investigates the dynamics of human rights violations in Kashmir by the Indian armed forces through the lens of framing theory and theory of conflict analysis.

This research paper has been published in Global Legal Studies Review (HEC Category-Y).
