Scientific collaboration across the world is changing at an unprecedented rate with the advent of artificial intelligence, cloud computing and digital research platforms. Sensitive technical knowledge can now be shared between scientists internationally via virtual laboratories, cloud technologies for collaboration, and AI tools to support research. These innovations promote peaceful nuclear cooperation, but they also reveal vulnerabilities in export control systems that are geared towards the physical movement of nuclear materials and technologies, not digital knowledge. With the growing technological competition, nuclear export controls must remain with cutting-edge technology, and this has become an important international security priority.
The Nuclear Suppliers Group (NSG) has been the cornerstone of multilateral nuclear export controls. Its effectiveness, however, does not so much lie in the preservation of rules as in their transformation with technological change. The NSG has contributed to non-proliferation goals, and to this end, has, through common guidelines and harmonized export control standards, facilitated legitimate civilian nuclear cooperation and trade. Today, however, the dangers to the NSG are not the same as those which prompted the creation of the NSG 50 years ago.
Decades of nuclear export controls have proven successful in curbing the proliferation of sensitive nuclear materials and technologies through concerted international export controls. But their traditional emphasis on physical export is under challenge due to the introduction of digital technologies and intangible transfers of technical knowledge.
Proliferation is not just the proliferation of nuclear materials or equipment. Sensitive knowledge on nuclear issues has changed hands because of emerging technologies. It can now cross borders with the help of cloud-based research, additive manufacturing, intangible technology transfer and digital communication. For example, cloud research platforms for collaboration are becoming more common, allowing controlled sharing of technical information from different parts of the world in real-time without requiring the export of information physically. This makes it hard to police intangible technology transfers, since sensitive technology data is now transferred electronically and no physical transfer takes place.
This challenge is reflected in virtual collaboration platforms. They enable engineers from various states to exchange technical information, which may be of a controlled nature, and work together on dual-use technologies without the exchange of any physical product. Export control regimes therefore need to go beyond merely containers and contents to algorithms, digital files and virtual research environments. Only physical export controls can no longer be sufficient in this context. Poor export controls help increase the risk that sensitive nuclear technologies will be used for unauthorized or proliferation activities, which threatens to undermine international security and decades of non-proliferation efforts.
Effective export control is emerging as a central strategic issue in the context of the sharp increase in investments in advanced manufacturing, quantum technologies, AI, etc. Numerous export control regimes have been unable to keep pace with the pace of technological evolution.
All these technological challenges are developing in the face of a more complicated geopolitical background. But the multilateral governance structures that are based on consensus are increasingly under pressure. In the wake of mounting strategic competitions, Global Value Chains are becoming more fragmented, and technological advances are accelerating. The pressures all add up and make it harder for institutions such as the NSG to respond quickly to new proliferation challenges.
The answer is, however, not to tear down the existing export control architecture. The NSG is one of the most successful models of multilateral cooperation related to nuclear non-proliferation. It retains its role as the main structure for the multilateral coordination of nuclear export controls among participating governments. In the last few years, NSG guidance has been reinforced to address these new challenges to intangible technology transfers. But these steps need to be part of a larger strategy for the export control regime to be more adaptive and resilient.
The maintenance of nuclear export controls can no longer be done with updates of control lists. More technical cooperation should be done, and the exchange of information and the participation of scientific and industrial sectors in export control should be increased. They should also periodically assess export control mechanisms to ensure they keep pace with rapidly changing technology and new methods of transferring knowledge through intangible means. Before the development of AI-enabled research platforms, cloud collaboration and additive manufacturing, among other emerging technologies, create gaps in export control rules; participating governments should put in place regular technical review processes aimed at evaluating these technologies. The establishment of technical knowledge and institutional capabilities will enhance the responsiveness of export control systems while maintaining legitimate cooperation for peaceful nuclear use. Nuclear non-proliferation will not be easy, as it will have to deal with the transfers of sensitive nuclear materials but also the increasingly complicated transfers of knowledge and technology. No longer is it a question of whether export controls are needed. The real question is whether export control regimes will be able to move quickly enough to remain relevant in a rapidly evolving technological landscape.
